When Texas first became a state in 1845 that was the agreement.
Texas reverted back to a nation when it left the union, and joined forces with the CSA.
After the civil war military was brought in and martial law was imposed.
That martial law was never lifted, keeping Texas in the status of a Captured Nation of War.
The deal of which you speak no longer is in effect, that's why Roosevelt's 1907 border land is workable in Texas.
