Judge Tosses Bulk Of Lawsuit Over Trump Ending Immigrant Reunification Program

 

SAN FRANCISCO (AP) — The Trump administration provided adequate justification for its decision to end a program that reunited hundreds of immigrants from Central America with family members in the U.S., a federal judge ruled Monday.

 

Magistrate Judge Laurel Beeler threw out the bulk of a lawsuit that argued the termination of the Obama-era Central American Minors program was arbitrary and violated the U.S. Constitution.

 

The program allowed parents legally in the U.S. to apply to bring children or other family members living in Honduras, Guatemala or El Salvador to the U.S.

 

One of the goals was to discourage children from making the dangerous journey from those countries to the U.S. to be with family.

 

More than 1,300 people came to the U.S. under the program between 2014 and the end of 2016, according to figures cited in Beeler’s decision.

 

When it ended the program in August 2017, the Trump administration revoked approval for roughly 2,700 additional immigrants who were set to travel to the U.S.

 

In her ruling, Beeler said the decision to revoke those approvals was arbitrary and capricious and required more analysis and explanation.

 

Linda Evarts, an attorney with the International Refugee Assistance Project who is representing plaintiffs, said she welcomed that part of the ruling and called the decision “an important first step.”

 

Beeler in a separate order suggested the plaintiffs might be able to revise their lawsuit to address some of her concerns.

 

The judge, however, found the administration had sufficient policy and legal arguments for its decision to end the Central American Minors program.

 

The Obama administration granted refugee or parole status to 99 percent of the people it interviewed for the program, giving them a greenlight to come to the U.S., according to State Department figures in Beeler’s decision.

 

The Trump administration argued that immigration law called for a more sparing, case-by-case approach. It also said granting parole broadly created an incentive for illegal immigration and contributed to security problems along the U.S.-Mexico border.

 

Beeler said the administration rationally concluded that the program was not consistent with its immigration policy and its view of immigration law. She said she was not authorized to second-guess those conclusions.

 

She also rejected arguments that the decision to end the program violated due process and equal protection.

Joy Reid Favorite Rants on Mark Meadows; 'Whites Don't Get a Vote' on What's Racist

 

Appearing as a panel member on Saturday's AM Joy on MSNBC, frequent guest Elie Mystal of AboveTheLaw.com went on a rant about Republican Congressman Mark Meadows, calling him a "racist," and declaring that "whites don't get a vote" in deciding who is "racist." For his part, MSNBC Republican Charlie Sykes laughed along approvingly and further complained that Republicans did not do more to combat the "cancer" of birther conspiracy theories.

 

At 11:07 a.m. Eastern, host Joy Reid preemptively suggested she would enjoy listening to Mystal – known for making incendiary comments in his MSNBC appearances – as the liberal analyst got his turn to react to the controversy over Congressman Meadows trying to defend President Donald Trump against accusations of racism.

 

JOY REID: I know you have a reaction, Elie. I feel in my heart that you might have a reaction.

 

ELIE MYSTAL: I know why members of Congress can't say this, because they have to work with the man, but I don't have to work with the man. Mark Meadows is so racist that he needs to be put on display at the African-American History Museum as an artifact, all right? I am so sick of Republicans thinking that the only racist people left in America are David Duke and Louis Farrakhan, all right?

 

White people don't get a vote! My people have been held in bondage and oppression in the New World for 400 years! My own counsel will I keep on who is to be called "racist," all right? So when these people – when these white Republicans try to tell me, and "Bagger Vance" standing behind her – when these people try to tell me who is racist and who is not racist, they need to understand that I do not care! What I care about is what their policies are and what their actions are. And Mark Meadows is a birther, so he can roll his behind out of here.

 

Host Reid then took the time to show clips of Congressman Meadows from several years ago joking about the possibility of President Barack Obama being born in Kenya, and then denying that he is racist, as she set up Sykes to give his analysis. She complained that Meadows "is willing to utilize birtherism for his own political advancement, and is willing to use the physical body of a black woman as a rebuttal against the idea that Donald Trump is racist."

 

The MSNBC host added: "This is like a problem a lot of people have with the Republican approach on race in general. What do you think?"

 

Sykes began by referring back to Mystal's rant with praise. "Note to self: Never follow Elie Mystal on something like this." The Never Trumper then proclaimed "this whole hearing was kind of a morality play in watching how people were setting themselves on fire to serve Trumpism." He then agreed that Mark Meadows is a birther, and "this has been, the sort of cancer the Republican Party failed to address, early on." It was Trump's "original sin."

Former ICE director explodes on Ocasio-Cortez’s ‘rape’ allegations: ‘I’m sick of this!’

 

The former acting director of Immigration and Customs Enforcement exploded on-air Sunday at self-described Democratic socialist Rep. Alexandria Ocasio-Cortez following her allegations that ICE agents are guilty of drugging children and “rape.”

 

In a series of tweets, the New York Leftist criticized Democrats for voting with Republicans on a last-minute amendment to a gun control bill expanding background checks that would require authorities to let federal immigration officials know if an illegal alien attempted to buy a gun.

 

It’s already against the law for people not in the country legally to attempt to purchase a firearm.

 

Democrat support for the amendment, seen as a common-sense gun control tool by most members of Congress, was too much for Ocasio-Cortez, who has now taken up the mantle of enforcer, apparently, demanding party purity on all votes.

 

“#MomsDemand & #MarchForOurLives activists, who flew in from across the country, were watching from the gallery, crying + confused.

 

I ran up to them during the vote and explained that the gotcha amendment pinned gun safety against immigration advocacy. Its intent was to divide,” she tweeted, adding:

 

“If you’re mad that I think people SHOULD KNOW when Dems vote to expand ICE powers, then be mad.

 

ICE is a dangerous agency with 0 accountability, widespread reporting of rape, abuse of power, + children dying in DHS custody.

 

Having a D next to your name doesn’t make that right.”
