INTERNET BILL OF RIGHTS

In layman's terms

Problem:

Regulators under four different presidents have taken four different approaches. Courts have overturned regulatory decisions. Regulators have reversed their predecessors. And because the internet is so critical to everyone, it’s understandably confusing and a bit concerning when you hear the rules have recently changed, yet again.

Solution:

It is time for Congress to end the debate once and for all, by writing new laws that govern the internet and protect consumers.

COMMENTS (FROM A FORMER FCC CHAIRMAN - HAROLD FURCHGOTT-ROTH):

IN THE MATTER OF

RESTORING INTERNET FREEDOM

CURRENT REGULATIONS ("THE ORDER") VIOLATE THE FIRST AMENDMENT:

The Order imposes speaker- and content-based burdens that violate ISPs’ First

Amendment rights, both by compelling their speech when they would otherwise prefer

not to speak and by restricting or otherwise burdening truthful and non-misleading

commercial speech. Such restrictions are subject to heightened scrutiny—a burden FCC

cannot meet. In any event, as explained below, the Order cannot withstand any level of

First Amendment scrutiny.

  1. The Order Unconstitutionally Compels Speech

  1. The Order Impermissibly Discriminates Among Speakers

I think a good start would be for us to read the comments IN RESPONSE TO THE PUBLIC NOTICE PUBLISHED

AT 82 FED. REG. 25,568 (June 2, 2017)

Q is teaching us to DIG and understand all sides.

From what I gather in reading a few comments about revisiting the regulations (There are currently Federal Regulations Title II) is that it is a shit storm mess and we are putting the power in the judicial branch because it is a mess.

Q is asking for Congress to write an Act that is clear and enforceable and doesn't leave it in the hands of our courts to interpret and does not impede on anyone's First Amendment rights.

Here are a couple of comments about the regulations. It is important we dig and educate ourselves on the issues:

If there isn't an easy legal framework to follow it is the WILD WILD WEST!
