i have regretted not replying to anons that make thoughtful comments but i was tooo late!
the bill of rights applies to state action - in the absence of a statute or SCOTUS case that extends these to non-state actors private persons and companies are not subject to the bill of rights - of course this sounds odd since many (but not all) of the bill of rights HAVE been so extended - ie housing and public accommodations cant discriminate - very complicated - in short all we need is for congress to pass an IBOR and POTUS to sign it - unfortunately congress is crap
