Psychiatrists and psychologists would have to clear people. Sounds great in theory, doesn't work in practice. They already do here to get your (Illinois) FOID card back if deemed danger to self or others.

 

I know a guy who had to spend $10k on a forensic psychologist after some resident shrink had him involuntarily admitted after he had an adverse reaction to shellfish, had to be sedated and intubated, woke up and went ape shit because he didn't know where he was. And they weren't going to restore his rights. Even when a psychiatrist said nothing is wrong with him. Shrinks HATE guns. Even if you get VERY lucky drawing a gun friendly shrink, the government will just run you around.

Yep I watch the damn thing as implemented now. And they just passed a red flag law here. Cops I know are really fucking nervous over gun seizure warrants. They REALLY do not wanna serve them because they believe they're unconstitutional and they also don't want someone opening up on them.

 

The revocation and restoration system is completely broken (see Martin case, a victim is suing ISP for $2M now). Only sworn law enforcement are exempted/given easier paths. They always exempt cops. They need to hold cops to HIGHER standards not LOWER standards.

 

Side note, there's a state appeals court case that restored a convicted felon's (forcible felony, burglary) gun rights after he kept his nose clean for 20 years and is an upstanding citizen. I'm all for that.
