If HRC gave the data to a Chinese third party or made it available to them in some way-

it isn't hacking.

Plausible deniability for FBI claim.

So now, if the third party donated to the CF in return for the goodies, that is more than

treason, Its also RICO.

Treason carries the more deleterious punishment.
