I certainly haven't finished reading LP testimony, but the impression I'm getting is that a) the sticking point was proving intent to mishandle classified material, and b) a possible directive from DOJ (Richard Scott) that no case of be brought anyway. (need to construct a timeline).
That's all not withstanding your concerns about SAP of course, but the case against the FBI, so far according to her testimony, is very gray.
I guess if access was granted to the SAP the nature of her server would have been evident to someone, and they may have pointed out to HRC that the server was not suitable for classified material to be stored on. And if she ignored that advice then she would be deliberately mishandling.
I haven't seen any evidence of that so far (unless it's under a redaction), but perhaps it is evidence that could have been gathered, thus pointing the finger back at JC etc.
