Feds Expose More Of Their Evidence – More Bad News For Raniere

 

And if you’re Keith Raniere, some days it’s just not worth getting out of your prison bunk at MDC.

 

Yesterday was one of those days…

 

First, came the news that Nancy Salzman, his original partner-in-crime in the NXIVM/ESP criminal enterprise, was going to plead guilty – and, in all likelihood, end up being one of the prosecution’s prime witnesses against him and his remaining co-defendants in the case of the U.S. v. Raniere Et Al.

 

Next, came a filing by the prosecution that exposes more of the evidence that it plans to introduce at his trial.

 

The new details were set forth in a Memorandum-of-Law that the prosecution filed yesterday in support of its pending motion to admit “certain racketeering evidence” in the case.

 

Before we get into the details, let me explain the legal context of this situation.

 

As readers of the Frank Report may recall, the First Count in the superseding indictment in this case – which, by the way, applies to all the defendants – is for “Racketeering Conspiracy”.

 

Commonly referred to as a “RICO charge”, the First Count involves various “predicate acts” that the prosecution alleges were undertaken as a part of a Racketeering Enterprise.

Senate talks collapse on avoiding Trump showdown over emergency declaration

 

Senate Republicans say talks to find a way to stop a House-passed resolution disapproving of President Trump’s emergency declaration over the southern border are collapsing amid Republican divisions over what some see as a breach of separation of powers.

 

Senate Republicans said Wednesday afternoon that Trump will not support a proposal sponsored by Sen. Mike Lee (R-Utah) to reform the National Emergencies Act of 1976 and require Congress to approve future emergency declarations after 30 days.

 

“It’s my understanding the president won’t support it,” said Sen. John Cornyn (R-Texas), a member of Senate Majority Leader Mitch McConnell’s (R-Ky.) leadership team, after meeting with colleagues at lunch to discuss the state of the talks.

 

Lee announced Trump’s position after taking a call from the president during the lunch meeting, according to a person familiar with the conversation.

 

Sen. John Kennedy (R-La.) told reporters after Wednesday's meeting that it’s clear the disapproval resolution will pass.

 

“'Dandy' Don Meredith used to sing a song at the end of the game when the result was obvious. It was called turn out the lights the party’s over. Well, that’s appropriate right now,” he said, referring to the former NFL quarterback.

 

“It’s time to vote, everybody knows how they’re going to vote. I don’t think the president’s going to win this one.”

 

There was a flash of hope Tuesday that a deal could be worked out with the White House whereby Trump would promise to support legislation curbing his power to declare future national emergencies in exchange for Republicans defeating the disapproval resolution.

 

But Trump decided against curbing his own presidential power, GOP senators said.

 

The disapproval resolution faces a certain Trump veto, and there’s not enough support in either the House or the Senate to override it.

 

“This president, like any other president, is not going to give up power that Congress has given him in the past. It’s been there since the 1970s. Why would this president give it up?” said a Republican senator who requested anonymity to talk about internal discussions.

 

The GOP senator said increasingly strained efforts by Republican colleagues to work out a deal to avoid passage of the disapproval resolution has “gotten to the point of being absurd.”

 

“I look at my colleagues and say, why would you expect a president to give up his power? Would President Obama have given it up? I don’t think so,” the lawmaker added.

 

Sens. Lamar Alexander (R-Tenn.) and Ted Cruz (R-Texas) are still pushing a proposal to pass an alternative resolution that would wall off the money available for Trump to redirect to building border barriers, said Sen. Marco Rubio (R-Fla.), who discussed the idea earlier on Wednesday with colleagues.

Cardinal George Pell, Former Vatican Official, Sentenced To 6 Years In Prison

 

Australian Cardinal George Pell, 77, a former leading Vatican official who last month was convicted of sexually abusing two boys, has been sentenced to six years in prison. He will be eligible for parole after three years and eight months.

 

During the sentencing hearing, Victoria state County Court Chief Judge Peter Kidd acknowledged the disgraced cleric may not live to serve the full sentence.

 

“I am conscious that the term of imprisonment, which I am about to impose upon you, carries with it a real, as distinct from theoretical, possibility that you may not live to be released from prison,” Kidd said to Pell.

 

The prospect of facing jail at Pell’s advanced age “must be an awful state of affairs,” Kidd added.

 

Pell was convicted in December of five sexual offenses committed against two 13-year-old choirboys during an incident in 1996 at Melbourne’s grandest cathedral, when he was archbishop.

 

A 12-member jury unanimously found him guilty of exposing himself to the two boys, fondling them and forcing one to perform oral sex on him. The jury also convicted Pell of indecently assaulting one of the boysmore than a month later.

 

A court-issued gag order had suppressed media reporting of the news until last month.

 

Following the sentencing on Wednesday, Vivian Waller, a lawyer for one of the victims, read a written statement by her client outside the court.

 

“It is hard for me to allow myself to feel the gravity of this moment, the moment when the sentence is handed down, the moment when justice is done,” the man wrote. “It is hard for me, for the time being, to take comfort in this outcome. I appreciate that the court has acknowledged what was inflicted upon me as a child. However, there is no rest for me. Everything is overshadowed by the forthcoming appeal.”

 

The other victim died in 2014 of a heroin overdose. He was 31 and never reported the abuse.

 

Pell denies the allegations, and his lawyers argue he has been made a scapegoat for the failings of the Catholic Church regarding sexual abuse by priests, NPR’s Sylvia Poggioli reported.

 

Pell has filed an appeal, and the court will determine if there are sufficient grounds for it to be heard. A court date has been set for June 5.

 

In court on Wednesday, Pell was told he will be a registered sex offender for the rest of his life.

 

He is the most senior Vatican leader ever charged with sexual abuse. He was selected by Pope Francis to run the Vatican’s new economic ministry.

Verizon says 5G network will cost extra $10 a month

 

A handful of Verizon customers will soon have faster wireless service - but they’ll have to pay $10 a month more.

 

Verizon says it’ll flip the switch next month on a much-hyped, next-generation “5G” phone network . Service will start in parts of Chicago and Minneapolis.

 

The offer is available only on unlimited plans, which currently start at $75 for one person without 5G. It requires Motorola’s Moto Z3 phone with a special 5G attachment.

 

Other 5G-enabled phones, including one from Samsung, will come this year. Verizon would not say how 5G pricing would work with those phones.

 

T-Mobile has said its 5G plans won’t be more expensive if its proposed takeover of Sprint goes through. Sprint hasn’t announced 5G prices. AT&T did not immediately respond to questions.

British MPs vote in favor of ruling out a ‘no-deal’ Brexit

 

UK MPs have voted to take a ‘no-deal’ Brexit off the table for good as they passed a motion that rules it out in a decisive 321 to 278 vote.

 

The option of a no-deal was first ruled out by MPs after an amendment originally tabled by Caroline Spelman passed by a close vote of 312-308.

 

The Spelman amendment says the House “rejects the United Kingdom leaving the European Union without a withdrawal agreement and a framework for the future relationship.”

 

The MPs then voted on the main motion, as amended, passing it with an even greater margin of 43, with 321 voting in favor and 278 against.

Flynn Asks For Another Delay in Sentencing to Cooperate With Related Criminal Case

 

Lt. Gen. Michael Flynn, once called by his supervisor “easily the best Intelligence professional of any service,” has asked a federal judge to further delay his sentencing for lying to the FBI.

 

Flynn had a sentencing hearing on Dec. 18 where U.S. District Court Judge Emmet Sullivan agreed with the defense to give Flynn more time to continue in his cooperation with a case in Virginia against two of his former associates, who face charges for concealing that they lobbied in the United States on behalf of Turkey.

 

Back then, Sullivan asked both sides to give him a status report on March 13. In the report, Flynn requested further delay.

 

“At this time, the defendant continues to request a continuance since the case in [the Eastern District of Virginia] has not been resolved, and there may be additional cooperation for the defendant to provide pursuant to the plea agreement in this matter,” according to the status report.

 

The prosecutors, from the office of special counsel Robert Mueller, took no position on the request, and said that “while the defendant remains in a position to cooperate with law enforcement authorities, and could testify in the [Virginia] case should it proceed to trial, in the government’s view his cooperation is otherwise complete.”

 

Flynn has extensively cooperated with government prosecutors on multiple investigations and further cooperation will give him yet more grounds to ask for a lenient sentence. Even before the delay, the prosecutors were asking for a low sentence, including no prison time, while the defense wanted no more than a year of probation and community service.
