As previously mentioned, this guy is in prisoner uniform. He has been in custody and would not have access to a ball point pen, as it is a "weapon" that can cause bodily injury. The only way he gets one is if his lawyer let him use it while in private consultation, or a guard or prosecutor gave it to him while under interrogation. Prisoners are not allowed anything that can be used to inflict harm. Imagine being stabbed in the neck with a ball point pen. That's why they can't have access to one.
