Trump hasn't submitted a nomination to the Senate for Rosenstein's replacement yet. The DAG runs the DoJ.
RR works in the Dept of Justice not the Dept of Defense. If this is enacted, it will be on the military first. Civilians are unionized. Political appointees don't follow the same rules as everyone else.
