Yes, it can be released, SUBJECT TO COMPLIANCE with all the other rules and regulations, including ethical conduct, applicable to DOJ actions, attorneys, and employees. (Per the DOJ Manual, federal statutes, and US code federal regulations)

Special counsels are required to comply with DOJ rules, regulations, procedures, practices, and
policies, and are directed to consult with the appropriate offices within DOJ or the Attorney General directly if
necessary. Id. ยง 600.7(a). Additionally, special counsels are subject to discipline for misconduct and breach of ethical
duties that are generally applicable to DOJ employees.
