Judge has no say in this. Judge is essentially a clerk granting prosecutor motion to drop the charge. Prosecutorial discretion to charge / no charge. Defendant isn't going to object to charges being dropped.

Back to the story of the US government working in collusion with the press to influence a US election, and then dissatisfied with the outcome, the US government continuing to work in collusion with the press to undermine the results of the election. Yeah, but Trump hasn't gotten off. Hillary is the one who got off. Trump is still under suspicion, just not to the level of criminal conduct. The conduct is lowered from criminal to an impeachable offense.

USA (US Attorney) in that district has discretion to charge if presented with evidence of a federal offense. Us of US mail to perpetrate a fraud is a federal offense.
