Jussie Smollett is being played by the white hats. The whole mission is to get more evidence.

So, the white hats know that they have damning evidence for the federal case (hate letter). They make it look like some deal has been made and release Smullett. Only thing is, the good guys are following every step he makes and every phone call he makes. White Hats see who he calls to give thanks, who he visits, etc.

Then after a week or two, after you got enough extra evidence. You drop the hammer with a federal indictment.

Smollett is a rat, he just doesn't know it.

If that were to be the case, then the white hats would be guarding Smollett.

Both stories can be true.

The evidence they might be going for is the hiring of a hitman or something like it.
