Hinkley prompted a radial revision of insanity defense. The defense lawyer here is doing what lawyers are trained to do, push the envelope, change definitions, and if they are lucky they get the judge to make new law.

 

I don't know of a "mental illness" defense, short of insanity, although there are likely some idiosyncratic carve-outs for specific conduct such as verbal outbursts attributed to Tourette's.

I would add to that, that many if not most practitioners of "law," and I include legislators in that cohort, think that law has the power, all by itself, to hold an orderly society together. Arrogant belief.

 

Law is a social tool, and it's okay as tools go. But it not the be-all end-all, and as with any tool, it can be abused. In modern times, the principles of law are flouted and abused. We are at a point where "if it's not a crime, it morally acceptable."

 

Sad.

If Smollett is smart, he'd pay the $130,000 and shut up. The money won't even come out of his pocket. I'd no-show the civil trial, get a default judgment, and pay off that way. Don't say a word.
