That the police and criminal trial evidence is sealed does not preclude a civil trail by the city to recover damages caused by Smollett. Much of the evidence can be (and would have to be) "created" anew. For example, call the two fellows who were hired to meet-up with Smollette, hand him a noose and whatever else. They testify. Judge or jury either finds them credible or not. Call the police who undertook the investigation. They can testify. They aren't gagged. There is no justification to gag them either, there is no criminal jeopardy, no tainting of a criminal jury.
