Q has mentioned that some will run just so that they can use as a defense against legitimate prosecution that the prosecution is a political attack. Prosecuting a political opponent in a presidential race raises constitutional, separation of powers issues, and is a legitimate defense.

Therefore, it is possible that Biden is taking the risk that his skeletons will come out just to ward off prosecution with a constitutional defense.
