the constitutionality of FISA and how SCOTUS analyzies
the basic idea is when there is any deprivation if a "fundamental right" (privacy and warrantless search) it can only be balanced and considered if the there is a "compelling govt purpose"
this is a VERY high standard legally and in these cases if SCOTUS finds a compelling need/purpose is will requitre the govt also to NARROW the extent of infringement as far as possible
ie high bar for warrants, internal checks and balances, sign offs by top officials etc
(ie the "Woods Procedures" were named after such a case)
MANY more safeguards were put in place after the Admiral Rogers report to the FISA court - and the program was renewed with the full support of POTUS
