Cook County State’s Attorney Kim Foxx’s handling of the Jussie Smollett case includes a long list of miscalculations. Add to it her decision Saturday to stand with U.S. Rep. Bobby Rush, D-Ill., as he called the Fraternal Order of Police “the sworn enemy of black people.”
“Let’s be clear,” Rush said at a Rainbow/PUSH Coalition rally supporting Foxx. “Kim Foxx, her battle, is with the FOP and all of their cohorts.”
Cohorts? Does he mean police officers?
This is what Rush is really good at: flipping tables. He turned legitimate questions regarding Foxx’s handling of a seemingly solid police investigation into an attack on cops. This is what he does. Don’t let him do it here.
The questions about Foxx, who won office in 2016 with the support of a diverse and welcoming electorate, are grounded in decisions she made to insert herself into the Smollett case, to let her office drop all charges against him, and to let court records stay sealed without protest. Her explanations regarding the case have been condescending and inconsistent. And then Saturday she decided to stand alongside a congressman known to hurl fireballs at law enforcement.
She is the lead prosecutor of the nation’s second-largest county. She is law enforcement. It might have been Foxx’s most egregious career mistake so far.

Petitioner for special prosecutor in Jussie Smollett case wants judge from outside Cook County to decide
A grand jury indicted Jussie Smollett on 16 counts of disorderly conduct in February. Cook County prosecutors on March 26, 2019, dropped all charges against Smollett on disorderly conduct charges. The 36-year-old actor vehemently denied lying to police and faking a homophobic attack in the Streeterville neighborhood on Jan. 29, 2019.
A retired state appellate judge who has petitioned for a special prosecutor to investigate Cook County State's Attorney Kim Foxx's handling of the Jussie Smollett case wants a judge from outside Cook County to make that decision.
In a court filing Monday, Sheila O’Brien argued that any judge in Cook County would have a conflict of interest if Foxx is called as a witness and her credibility becomes an issue — an apparent reference to the close working relationship between judges and prosecutors.
The decision whether a special prosecutor should be appointed would typically be made by presiding Criminal Division Judge LeRoy Martin Jr.
O’Brien filed the petition Friday asking that a special prosecutor investigate last month’s sudden dismissal of charges by Foxx’s office against Smollett, an actor on the TV show “Empire.”
That request is slated to be taken up by Martin on May 2, but O’Brien’s filing seeks to have a judge from outside Cook County assigned sooner if possible.
Judges from outside Cook County are more commonly appointed on matters directly affecting a judge. For instance, a judge from Will County was brought in last year to handle a misdemeanor gun charge against Cook County Judge Joseph Claps, who was acquitted.
Veteran criminal defense attorney Robert Loeb called O’Brien’s filing creative but bare-bones, noting it made little in the way of specific legal arguments.
“She raises some interesting thoughts, but there’s no precedence for what she’s asking for,” said Loeb, who teaches at DePaul University College of Law. "(But) if Cook County judges would be put in an uncomfortable position hearing this case, what's so terrible about having an out-of-county judge?"

Brexit: Theresa May meets Angela Merkel for delay request
Theresa May is holding last-minute Brexit talks with the leaders of Germany and France, with the UK due to leave the EU in three days time.
Mrs May met Angela Merkel in Berlin, and will meet Emmanuel Macron in Paris, as she urges both to back her request to delay Brexit again until 30 June.
The prime minister will be at an emergency summit on Wednesday when all EU states will vote on an extension.
Cross-party talks aimed at breaking the impasse are also set to continue.
The negotiating teams will be joined by Chancellor Philip Hammond, Environment Secretary Michael Gove and shadow chancellor John McDonnell, with the Labour frontbencher saying they hoped to "broaden the talks".

President Bill Clinton and Naomi Campbell are among the rich and famous who have flown aboard convicted sex offender Jeffrey Epstein’s private jet, according to flight logs from Epstein’s private aircraft.
The flight logs from 2003-05 have been filed in one of the many civil lawsuits pending against the billionaire money manager. Nearly two dozen young women have filed lawsuits against Epstein — some already settled — all alleging Epstein sexually abused them as minors at his El Brillo Way home.
Epstein, 57, was released from jail in July after serving 13 months of an 18-month state sentence for soliciting a minor for prostitution and soliciting prostitution.
Attorney Brad Edwards, who represents Jane Doe and two other Epstein victims, filed the flight logs to back up his case that Epstein traveled across state lines for the purpose of sexually abusing Jane Doe and other victims.
“Epstein engaged in the act of trafficking minors across state or country borders for the purposes of sex or prostitution between 2000 and the present. … Epstein used the fact that he had transported other minors across state and country borders for sexual purposes to help persuade Jane Doe to be sexually abused by him. Epstein also asked Jane Doe to bring other girls to him. Epstein committed the same sorts of acts against other minor girls,” Edwards wrote in his pleading.
There are no allegations that anyone who traveled on Epstein’s airplanes had anything to do with the sexual abuse, other than Epstein employee Sarah Kellen. Kellen acted as Epstein’s procurer, according to many of the teens, court documents and police reports.
The flight logs are for his Boeing 727 and Gulfstream jets.
Epstein, who has donated more than $100,000 over the years to candidates from the Democratic Party, has also hosted several high-profile Democrats aboard his aircraft.
Clinton flew with Epstein from Nov. 4-9, 2003, to destinations that included Oslo, Norway; Russia, Hong Kong, Shanghai and Beijing. On April 2, 2003, Campbell flew from the U.S. Virgin Islands to Brazil.
Failed Palm Beach mayoral candidate Gerry Goldsmith also was a guest on Epstein’s plane, traveling from Palm Beach International Airport to New Jersey’s Teterboro Airport on Oct. 19, 2003. Former Harvard president and current director of the White House’s National Economic Council Larry Summers flew more than once on Epstein’s aircraft.
Also flying with Epstein during those years: Sandy Berger, who was the country’s national security adviser under Clinton; former Colombian President Andres Pastrana; and high-profile attorney Alan Dershowitz, who is part of Epstein’s defense team.
