But all such debts, obligations and claims shall be held illegal and void.

The Supreme Court is the least powerful of the branches and can be rendered completely impotent by an Act of Congress. Don't worry about stacking SCROTUS, worry about having a president who knows when to ignore it.

 

For example, the Marbury v Madison verdict was given in a hotel lobby and President James Madison didn't even send anyone to receive it. That's how much respect SCROTUS was meant to have. Jefferson and Madison thought the federal courts were total dogshit because of how they could be abused especially by the "money interests" (Rothschilds). In fact the federal courts were never expected to be used much if at all. The delegates to the 1787 convention in Philadelphia stressed that it was absolutely improper for judges to create law.

Also: Cruel and Unusual Punishment is a restraint against the judiciary, not Congress. It was supposed to stop judges from inventing remedies or penalties that had no basis in the written law.
