It's complicated.
The press does the public a disservice by making NO EFFORT to educate on fairly simple legal principles.
The Congress does not hold any judge's feet to the fire, even though that is a Congressional function. You hear about all this "oversight" responsibility? It goes to judges too, but Congress abdicates that part of its role.
Our federal government is totally dysfunctional.
Dictionaries, history, text-books, all full of social-bending stuff. Technology enables this powerful dishonesty.. The downspin was enabled starting with radio, in the 1920's. Passive "consumers" of spin.
