We need to come up with a LEGAL definition of religion. Some tests that determine whether or not a set of beliefs is religion. The word comes from Latin and means relinking with God. So if a legal definition required that the religion involved communion with a higher power that loves us, but disallows anything that involves hate against other in God's creation, or anything that divides or moves further from God, we would have legal recourse to use.
When some terrorists claim that Allah hates the Jews, we charge them because they have lost the protection of religion. But Islam, the religion of peace is still protected. If a priest rapes a young boy and the bishop claims special status due to religion, we arrest both the priest and the bishop. They have lost protection by going against religion. But the Catholic church is still treated as a religion. In extreme cases, some buildings and property can be confiscated. And when a rabbi is shown to engage in Human sacrifice in the basement of a synagogue, all the participants can be arrested and the property seized and the building razed to the ground to create a small public park. Because that is no longer a place of religion.
