SUMMARY: This section mainly focuses on Paul Manafort’s indictment and subsequent conviction related to eight felony accounts covering a 12-year period prior to and including his brief time spent on the Trump campaign, none of which had anything to do with collusion. Although the Special Counsel’s office attempted to flip Manafort, he remained steadfast and plead guilty to these charges. J. President’s Conduct Towards Flynn, Manafort, HOM

Trump asked Flynn to resign on 2/13/17. In public, Trump praised Flynn’s character. Trump asked his advisors to tell Flynn that he “cared about him” and to “stay strong.”

On 11/17, Flynn began cooperating with Trump’s Office and on 11/22/17, he withdrew from a joint defense agreement with Trump. Flynn’s legal counsel communicated with counsel for both Trump and the WH, stating that Flynn had to cease “confidential communications” with Trump. Trump’s counsel left a voicemail for Flynn’s counsel stating that if Flynn had made a deal with an agency within government, they needed to know. On 11/23/17, Flynn’s counsel returned a call to Trump’s counsel acknowledging their voicemail and reaffirmed that information could no longer be shared with Trump. Trump’s counsel disagreed and interpreted this as Flynn’s hostility towards POTUS. Flynn’s counsel saw this as an attempt to make Flynn reconsider this decision.

Paul Manafort and Richard Gates (deputy campaign manager) were indicted by a D.C. grand jury on 10/27/17, on multiple felony accounts. On 2/22/18, they were indicted with additional accounts by an Eastern District of Virginia grand jury. The charges against Manafort covered the period from 2005 to 2018.

In 1/18, Manafort assured Gates that they would be taken care of, suggesting that they would be given special protections under Trump’s direction based on Manafort’s communication with Trump’s counsel. Manafort discouraged Gates from pleading. Manafort denied any reference to a “pardon” [presumably by Trump] when asked by Gates.

Trump did not believe Manafort knew what he was doing on the Trump campaign and that he did not like Manafort. Trump asked his aides whether Manafort may have information harmful to him and wondered if Manafort was cooperating the Special Counsel’s investigation.

Publicly, Trump criticized the prosecution and suggested Manafort was being treated unfairly. On 6/15/18, Trump stated to the press that he felt bad about Manafort’s situation, specifically that the grand jury reached back 12 years into Manafort’s activities, and restated his desire to see fair treatment of Manafort. Later that day, Manafort’s bail was revoked and he was further charged with tampering with a witness while out on bail. Trump tweeted a reply reminding that Manafort had worked on other campaigns, that he didn’t know “Manafort was head of the mob”, and he was unfairly treated. Trump also questioned lack of oversight with Comey, “Crooked” Hilary and others.

Rudy Giuliani is Trump’s personal lawyer. When interviewed just after Manafort’s bail, he suggested that it is within the scope of Trump’s powers to pardon Manafort, should he wish to, but that he could not while the Special Counsel’s investigation was ongoing. He commented on this topic across different interviews with essentially the same message, that a pardon is Trump’s prerogative, should he decide, but that it is neither a given nor is it off the table, especially when it was suggested that his or Trump’s comments influence defendants’ cooperation in the investigation.

On 7/31/18, Manafort’s criminal trial began (ED of VA), with heavy media coverage. Trump complained in a tweet the next day that AG Sessions needed to stop the “rigged witch hunt,” that Mueller was conflicted and that “17 Angry Democrats” were doing “his dirty work.” Another tweet reminded that Manafort was only briefly involved in the Trump campaign and that he should have been made aware that Manafort was under investigation at the time he joined. Trump reiterated that current charges had nothing to do with collusion and questioned why Manafort was serving solitary confinement without conviction. The press queried Sarah Sanders about Trump’s tweets and she reaffirmed Trump’s complaint about Manafort’s unfair treatment.

On 8/17/18, while Manafort’s jury deliberations continued, Trump was questioned by reporters about the trial. Trump responded again with it being a “rigged witch hunt” and refuse to discuss whether he would grant Manafort a pardon. Trump reaffirmed his position that the Manafort trial was a “sad situation”, and “sad” for the country. He described Manafort as a “very good person” to which Manafort’s attorney later expressed appreciation for Trump’s support.

On 8/21/18, Manafort was found guilty on 8 felony accounts. On this date, Michael Cohen also plead guilty to 8 offenses, including campaign-finance violation, which he claimed occurred with Trump’s knowledge. When speaking with reporters, Trump continued to reaffirm Manafort’s good character and his unfair treatment. He followed up the same sentiment in a tweet and contrasted Manafort with Cohen, further affirming Manafort’s character and refusal to lie to get a “deal.”

Trump was interviewed by Fox news on 8/22/18, and alluded to Cohen having “flipped” in order to get a better deal (judgment) and contrasted him with Manafort. Trump refused to discuss the possibility of a pardon for Manafort, but reaffirmed his respect for him. Giuliani continued to affirm Trump’s disgust for Manafort’s treatment and that he and Trump had considered the “political fallout” that could occur if a pardon to Manafort was granted. In another interview, Giuliani indicated that Trump had consulted with lawyers about the possibility of pardoning Manafort and other aides.

On 9/28/18, Manafort plead guilty to charges in DC, and signed a plea deal requiring him to “cooperate with investigators.” Apparently, Giuliani said publicly that Manafort remained in a “joint defense agreement” with Trump while having plead guilty and cooperating with the investigation. He also said Manafort’s attorney also remained in contact with Trump’s lawyers on topics discussed and information provided to the Special Counsel’s office. On 11/26/18, a public court filing by the Special Counsel’s Office revealed that Manafort had lied about multiple subjects and had breached his plea deal. Giuliani stated Trump had been very upset over Manafort’s treatment, calling it “un-American” and “horrible.” On 11/28/19, Trump described Manafort as “brave” for not having “flipped.” He railed against the use of “flipping,” or lying, by prosecutors to get defendants to say what prosecutors want. Trump referenced Manafort, (Jerome) Corsi and an unnamed (HOM) as three who did not flip and he called them “brave.”
