TLDR; This section describes the time during which General Flynn came under fire from Congress and the press and was subsequently dismissed by POTUS, Sessions recused himself from the Russia investigation and wheels were set in motion for the appointment of the Special Counsel. It does NOT include that appointment. Various media reports were considered valid testimony. Inasmuch as many media reports of the day were unreliably sourced and highly speculative, this does not seem reasonable.

 

On the question as to whether POTUS committed obstruction of justice in re: Flynn, Mueller (et al) concluded that his actions likely satisfied 3 of the 4 required elements, but not the fourth, “intent”.

 

If intent is lacking, then the crime of obstruction of justice did not happen, no matter how the actual events played out. The determination regarding the other three elements is based on how others might have subjectively understood his words and on the contemporaneous actions of James Comey, who was later shown to have lied and deliberately leaked confidential information to the media (which is its own crime). That, to me, raises doubts as to his motives for those contemporaneous records and conversations and thus whether he understood POTUS words as they were stated or twisted their plain meaning to suit his own agenda which was, from the beginning, in opposition to the Presidency of Donald J. Trump. If Mueller can speculate as to POTUS intent, I can just as reasonably speculate about the motives of James Comey.

 

Although the term “collusion” is mentioned several times, it is worth reminding readers that “collusion” is nothing more than a synonym for “cooperation” and is not a crime.
