The Governor's statement:

“It should go without saying that regular citizens have no authority to arrest or detain anyone,” the governor of New Mexico, Michelle Lujan Grisham, said in a statement to The New York Times, adding that it is “completely unacceptable” that migrants be “menaced or threatened” upon entering the U.S.

Did find a link from NM Judge stating New Mexico recognizes Common Law:

"New Mexico has no statute on citizen's arrest. Instead, our courts have continued to recognize the Common Law concept, ruling that a private citizen can detain a fellow private citizen when there is at least probable cause to believe that the fellow citizen has committed a felony-level crime or a breach of the peace in his presence."

Curios to see how this plays out as the militia a) did not use excessive force, b) detained but not physically restrained the illegal aliens, c) illegal entry into the United States outside ports of entry is considered a felony and d) properly turned them over to law enforcement officials.
