The Florida Commission on Ethics, in an apparently unexpected move, subpoenaed Andrew Gillum’s brother, Marcus Gillum, to testify live during the former mayor’s ethics hearing this week.
But Andrew Gillum’s lawyer, Barry Richard of Tallahassee, tried to block the move in an emergency motion filed Monday. Richard wrote that Marcus Gillum appeared Monday for a deposition under the assumption it would be allowed in court in lieu of live testimony. He said the Ethics Commission’s advocate, Elizabeth Miller, didn’t object.
“However, when Mr. Marcus (Gillum) traveled from Chicago and appeared for his deposition this date, he was served with a commission subpoena for appearance at final hearing,” Richard wrote. “Mr. Gillum was fully deposed, including extensive cross-examination by the advocate. There is no reason to believe that anything new could be elicited from Mr. Gillum.”
Miller, who acts as prosecutor for the commission, fired back, saying she tried unsuccessfully for two months to secure service on Marcus Gillum as witness in the hearing. She said she never agreed to allow the deposition instead of calling Marcus Gillum as a witness
