TheSCOReportsuffersfromanextraordinarylegaldefect:Itquitedeliberatelyfailstocomplywiththerequirementsofgoverninglaw.LesttheReport’sreleasebetakenasa“precedent”orperceivedassomehowlegitimatingthedefect,IwritewithboththePresidentandfuturePresidentsinmindtomakethefollowingpointsclear.IbeginwiththeSCO’sstatedconclusionontheobstructionquestion:TheSCOconcludedthattheevidence“prevent[ed][it]fromconclusivelydeterminingthatnocriminalconductoccurred.”SCOReportv.2.p.2.But“conclusivelydeterminingthatnocriminalconductoccurred”wasvortheSCO’sassignedtask,becausemakingconclusivedeterminationsofinnocenceisneverthetaskofthefederalprosecutor.Whatprosecutorsaresupposedtodoiscompleteaninvestigationandtheneitheraskthegrandjurytoreturnanindictmentordeclinetochargethecase.Whenprosecutorsdeclinetocharge,theymakethatdecisionnotbecausetheyhave“conclusivelydetermin[ed]thatnocriminalconductoccurred,”butratherbecausetheydonotbelievethattheinvestigatedconductconstitutesacrimeforwhichalltheelementscanbeproventothesatisfactionofajurybeyondareasonabledoubt.Prosecutorssimplyarenotinthebusinessofestablishinginnocence,anymorethantheyareinthebusinessof“exonerating”investigatedpersons.IntheAmericanjusticesystem,innocenceispresumed;thereisneveranyneedforprosecutorsto“conclusivelydetermine”it.Noristhereanyplaceforsuchadetermination.Ourcountrywouldbeaverydifferent(andverydangerous)placeifprosecutorsappliedtheSCOstandardandcitizenswereobligedtoprove“conclusively…thatnocriminalconductoccurred.”
