IMO some optics involved there.

He's giving them every chance to flip, admit fault, turn away from evildoing.

Just like God does:

2 Peter 3:9

The Lord is not slow about His promise, as some count slowness, but is patient toward you, not wishing for any to perish but for all to come to repentance.

 

(Knowing that some, many, will not choose repentance but will continue in evildoing and will indeed perish, according to the lawful judgment that will be carried out by tribunals.) It's the right thing to do. It's the mark of a just man.

Gross Negligence. An indifference to, and a blatant violation of, a legal duty with respect to the rights of others. Gross negligence is a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable grave injury or harm to persons, property, or both.

 

Knowingly is part of the legal definition of gross negligence.
