What I learned in law school:

(1) Distractions = things to keep you busy doing the wrong thing.

(2) Foils = things that point you to the wrong place and force you waste time.

(3) You win in court on Evidence and Procedure (not truth).

(4) You win bigly if you can settle out of court.
