Yes, but they had to have a legal case/reason to be granted a surveillance warrant on Mike. The call they listened to was made in the WH. They should not have had a warrant to surveil an incoming admin. POTUS' tweet makes it sound like they were watching F before they were even elected.

He might be pointing out that this was a coup vs. a normal investigation. If your investigating people in the campaign, you tell the person on the ballot. If its a coup, you investigate people inorder to disrupt their ability to be elected and possibly jail them.
