Second U.S. appeals court rules Trump cannot end protections for 'Dreamers'

WILMINGTON, Del (Reuters) - A U.S. appeals court ruled on Friday that President Donald Trump cannot end a program that shielded from deportation immigrants brought into the country illegally as children, the second time the administration has lost an appeal on the issue.

The 4th U.S. Circuit Court of Appeals in Richmond, Virginia, said in its ruling that the 2017 rescission of the Deferred Action for Childhood Arrivals, or DACA, program violated administrative law because the policy change was not adequately explained.

The ruling reversed a decision by a federal court in Maryland, and sent the case back for further proceedings.

The Department of Justice declined to comment.

Republican Trump's Democratic predecessor, Barack Obama, began DACA in 2012. It shielded a group of immigrants known as "Dreamers" and has given them work permits but not a path to citizenship. About 800,000 people, mostly Hispanics, have received DACA protection.

Trump has taken a stern stance against illegal immigration. His administration announced plans in September 2017 to phase out DACA, arguing that Obama exceeded his constitutional powers when he bypassed Congress and created the program.

Rights groups, states and individuals filed numerous lawsuits against the Trump administration over the decision to end the program. A series of lower courts have generally ruled against the government, leaving DACA in place for now.

The appeals court in Virginia found by a 2-1 decision that the rescission of DACA was arbitrary and capricious and violated administrative law.

Judge Robert King, appointed by Democratic President Bill Clinton, and Judge Albert Diaz, appointed by Obama, formed the majority. Judge Julius Richardson, who was appointed by Trump, dissented.

A similar decision was reached by the 9th U.S. Circuit Court of Appeals in San Francisco in November, which upheld a lower court injunction against ending the program.

The Supreme Court currently has three Trump administration appeals pending that seek to revive the administration's DACA proposal but the justices have so far delayed acting on them. It is likely the conservative-leaning court will ultimately have the final say on the issue.

On Thursday, Trump unveiled a proposed overhaul of the U.S. immigration system to favor educated English speakers over people with family ties to Americans, a plan he will push in his 2020 re-election campaign.

But the plan did not include protections for 'Dreamers,' a sticking point for Democratic lawmakers who say a permanent fix for this group of immigrants must be part of any proposed policy changes.

Trump officials not sending migrants to Florida after backlash

U.S. Customs and Border Protection (CBP) does not plan to send migrant families to Florida after reports about a Trump administration proposal resulted in backlash from local and state officials this week.

A CBP official told The Hill on Saturday that the administration is not looking at transporting family units to Florida "at this time" but said officials were looking at housing migrants in other areas across the country.

It was reported earlier this week that the administration planned to send hundreds of migrant families to Broward and Palm Beach counties, two Democratic strongholds in Florida that are among the state's most populous areas.

"Because of everybody's efforts, we are able to stop what had appeared to be a crisis for our community," Palm Beach County Sheriff Ric Bradshaw said in a statement Saturday, local TV station WPTV reported.

Florida Gov. Ron DeSantis (R), an ally of President Trump, was among those who pushed back on the reported plans, saying Friday that the proposal was "not acceptable" and that it might not go into effect.

"I'm going to be addressing this," he said. "This is not something that came down from the White House. This was something that came out of the agencies."

DeSantis's office did not immediately respond to a request for comment from The Hill on Saturday.

A CBP official said in a statement obtained by The Hill that Immigration and Customs Enforcement aircraft were flying people from areas in the Rio Grande Valley in Texas to San Diego and Del Rio, Texas, and moving individuals by bus in other areas.

New York State Senate introduces bill to make texting while walking illegal

A new bill introduced by the State Senate would make it illegal for people to cross streets in the state with their eyes glued to their smartphone.

About Those Dancing Israelis

On Friday Whitney Webb of Mint Press News wrote about new information on the 9/11 “Dancing Israelis” and their connection to Israeli intelligence.

Tehran urges US to declassify its 'intelligence' on Iran threat in Iraq

Iran’s ambassador to the UN has called on the US government to declassify its alleged intelligence on "Iranian threat" in Iraq, saying Tehran is confident the claim is "fake".

“If they have credible evidence and information, why don’t they declassify them and make it known to the American people and to the people of the world?” Iranian Ambassador to the UN Majid Takht-Ravanchi said.

He made the remarks in a Thursday interview with CBS News channel in reaction to the US claim that “Iranian proxies” in the region are posing threat to US interests.

“As long as they cannot share this so-called intelligence, which we call fake intelligence, there is no utility in saying that these information are credible,” he added.

The ambassador said reports that “Iranian proxies” are posing a threat to the US forces in the Middle East “are part of the same propaganda tools that Americans are employing."

"These are the same fake intelligence that is being used to provoke,” he added.

The Iranian ambassador also said he believes President Trump does not want a war, “but that does not mean that people who are close to him share his opinion.”

“I do not want to involve myself in the American politics, but the fact of the matter is that those hardliners in the administration have been trying to provoke, to agitate, to create the necessary grounds for a war, for a conflict with Iran,” he said.

A few hours before the interview, President Trump told reporters he hoped the two countries don't go to war.

Lauren Salzman’s Sensational and Damning Testimony

US ready to approve Israel’s ‘colonial policies’

The US is getting ready to approve Israel’s “colonial policies” by disregarding Palestinian rights, Palestinian Foreign Minister Riad Malki said Friday, Anadolu Agency reports.

“Two days ago, the Palestinian people commemorated the 71st anniversary of the Naqba – the Catastrophe – and while their disposition continues, one can not but reflect on this long journey of a nation that refuse to die or disappear and continues to strive for its rightful place in history and geography among all the nations of the world,” he told the Chatham House think tank in London.

“Throughout those decades, Israeli policies aimed to displace and replace the Palestinian people and ensured confinement of the Palestinians and expansion of the Israeli settlers with as objective of deposition of maximum land with minimum Palestinians,” he said.

The former Minister of Information and government spokesperson was referring to Palestinian figures that show more than 650,000 settlers currently live on 164 Jewish-only settlements built illegally throughout the occupied West Bank and East Jerusalem. Those territories were occupied in the 1967 Middle East war.

The Palestinians have laid claim on the territories for a future state, alongside Israel.

US President Donald Trump’s “deal of the century” drew criticism from Malki who said it offered Palestinians “no independence, no sovereignty, no freedom and no justice.”

The deal was engineered by Trump’s son-in-law and top advisor, Jared Kusher, who said recently the proposal “will lead to both sides being much better off”.

No one outside the US administration has seen the plan that Washington said could be disclosed sometime next month.

“One way or other, they are the ones who are delusional, not us,” Malki added.

“This can not be the future of Palestine,” Malki said.

“We are in the final phases of this master plan that Israel is no longer even trying to hide and which can only be qualified as colonialism under the disguise of occupation,” he said.

Breaking: Air Defense Forces Intercept Unidentified Objects Over Southern Syria (Video)

The Syrian Arab Air Defense Forces (SyAADF) intercepted several unidentified aerial objects over the southern part of the country in the late hours of May 18.

“Unidentified objects entered the airspace of the southern region from the occupied areas, air-defense systems are intercepting them,” a short press release by the Syrian Arab News Agency (SANA) said.

No explosions were reported on the ground. This allowed experts to speculate that the aerial objects were decoy missiles or balloons launched by Israel.

Palestinian history is repressed, their ancestral homes given to Jewish-Israelis

Most Palestinian citizens of Israel descend from those Palestinians who were not expelled outside the nascent state of Israel during the Nakba of 1948. This is not to say they were not displaced; many were forcibly driven from their ancestral villages into neighbouring population centres. Yet unlike their compatriots who found themselves in what was then the Jordanian West Bank, the Egyptian-controlled Gaza Strip or neighbouring Lebanon and Syria, these Palestinians were granted citizenship in the new Israeli state.

Today, the Palestinian narrative is repressed within Israel, which refers to 1948 as its War of Independence. Despite the fact that some NGOs such as Zochrot have worked to redress this erasure of Palestinian history running visits to depopulated villages which have since been covered over by national parks, forestation projects or purpose-built towns, discussions of the Nakba in schools, the public sphere or media are limited.

Since the creation of Israel, its Palestinian citizens have been depicted as an internal threat, a “fifth column” in need of constant surveillance. Historically this was born out in martial law, which applied only to Palestinian citizens between 1948 and 1966.

Although martial law is no longer imposed, the rhetoric which motivated its existence remains. This was seen once again during last month’s election, when Prime Minister Benjamin Netanyahu’s Likud party used anti-Arab slogans and PR stunts to depict Palestinian citizens as a threat and dissuade them from going to the polls.

Netanyahu has also parroted the old trope that Palestinians do not belong in Israel because they have “22 other states to go to”. This rhetoric not only ignores the historical presence of Palestinians throughout Israel’s history and prior to the state’s creation, but their status as Israeli citizens who should be afforded the same rights as their fellow Jewish compatriots.
