While i would agree with some of your analysis i think your missing some key points.

 

  1. He's not testifying because he handed the dems an impeachment sound bite. By explicitly saying that if there was no crime they would say so automatically makes the assumption that there were crimes but they could not charge.

  2. By refusing to testify he can say whatever he wants and will never be held accountable. He will not have to answer any opposing questions or justify anything in the report.

  3. By retiring and going into the private sector, he cannot be held accountable or even held under any rules set by the DOJ… basically the same as everyone else who "retires" when shit would roll down hill. Immunity.

 

Ultimately, this was a last ditch effort to throw political shit at POTUS. The job of a prosecutor is to indict or not. It is not the job of a prosecutor to exonerate. And by failing to officially coming to a conclusion regarding obstruction he politically tainted the whole thing. Be he did not indict, or even say that there would be indictments if POTUS were not POTUS, its been exposed as the continuance of political dirt slinging, and just enough to continue the attacks.

Even so, it basically said that the clinton investigation was done by the "book"… the only actions of question (not illegal, just bad judgement) were by comey.

Agreed, everyone knew that the russia russia was a hoax. The whole point was to keep it running long enough to effect the midterms along with collecting random things they could misconstrue as obstruction so that the dems in the house could use it as a basis for impeachment.
