I don't think this is actually the maximum possible. As I understand it, the maximum punitive damages would be 3 times as much as the compensatory damages. The compensatory damages were ~$11m. Three times that would be ~$33m. $33m + $11mn would be $44mn.

Although Oberlin could easily afford to write the check, given the amount of money involved, it's likely they will appeal. However, the clock on the statutory interest began the moment the Judge brought the gavel down and Oberlin will need to take that into consideration, too. If they lose on appeal, there might exist a possibility of the other $11m being levied. I dunno, I'm not a lawfag.

One thing we can be fairly certain of is that this will affect their endowments and it might simply be better to "pay the man the $5" and put this in the rear view mirror. It's also probably not a good time for the Provost to ask for a raise.

If Gibsons is looking to sell out, I'd be happy to offer them "$1.00 and other valuable considerations" for the key to the door (and contents therein). I'd be willing to continue the current employment for a minimum of 3 months for any employees willing to remain.

Train cars have 1 square inch of contact with the rails, spread between all eight wheels. That makes them very fuel efficient due to low rolling resistance and very hard to stop. How LONG after impact was the photo taken? Lots of gross tonnage and (probably) internal pumps to keep it level when the cargo is pumped out. Not certain what we are actually looking at because, without some sort of time reference, we can't even guess. In the photo of the blasted hole + diver, there was no oil escaping below water / discoloring the metal and the photo looked old … like marine life many have begun growing on it. I questioned whether it was the same vessel or if the blown hole might have been from an older wreck. I also questioned, but withheld judgment for lack of knowledge, about the direction of the blast.

Plenty of questions but, with the info we have at present, not many definite answers. Given calm seas, it seems likely that this ship could at least continue to the nearest port capable of taking the rest of the crude from her. Maybe more slowly and maye with a skeleton crew … but if it doesn't sink, it will have to be moved.
