Since Kellyanne's "duties and responsibilities of whose position continue outside normal duty hours and while away from the normal duty post; and who is an employee paid from an appropriation for the Executive Office of the President," it seems to me that she would be exempted from the prohibitions of Section 7324(a), especially if she is not physically present in the White House (e.g., being interviewed on the WH lawn or in a TV studio or at a rally).
Also note that the Penalties shown in Section 7326 (see pic) only cover removal from position or else a suspensionn. Kellyanne is completely right that there would be no jail time involved.
