I can't say for sure, of course, but these two don't look dead to me. And let's just say I've stood over A LOT of dead folks…a whole lot. I was a patrol watch commander in the murder capital of Florida for many, many years. The officers to go the Signal 7s (dead) on and around their beats…the supervisor to all in their sector, but the watch commander goes to ALL of them. So, yeah, I've seen every way you can leave this Earth and some you never heard of.

 

That said, these have 'fresh' color. I can't see any post mortem lividity…where the blood pools due to gravity from not being circulated anymore. Also, why are the dad's feet not pointing toes down…calves are much tighter than the toe raisers and win…he would almost have to be pulling his toes up to balance his footing or something other than a flacid release of muscular tension at death.

 

The little one's arm appears to be in rigor mortis, but the father doesn't…if they are in rigor, you'd have lividity and probably pretty bad. Weird.

 

Both of their mouths would appear to be out of the water and why if his shirt is wet, isn't his hair wet? Maybe they're freshly drowned…very, very freshly, but it looks staged to these veteran eyes. Can't say for sure, but looks spoopy.
