one obvious precedent is the photo of the Vietcong terrorist getting executed on the streets of Saigon in 1968. What textbooks and magazines neglect to say about that photo is that the Vietcong in question had just performed a home invasion in which he killed a half-dozen family members - mostly women - of a South Vietnamese army officer. One of his daughters hid in a closet and lived to tell the tale.

 

While the legal process called for this Vietcong to be taken to a police station where he could be charged, in reality he would have been sentenced to execution anyway, and prior to his execution date he would have suffered immensely in the Con Dao prison offshore. So really, shooting him on the street was a mercy.
