lawfag here - comments on the SCOTUS census question - this iwas NOT a loss for POTUS nor was it a win - SCOTUS just delayed it - for political reasons? Perhaps - but it does appear the DOJ blew it - they failed to make a proper administrative record. And then they jumped the gun in implementing the decision so that it reasonably appeared they had decided what they wanted in advance - OK SCOTUS said even that was fine - to have a policy is part of their job
However what was not fine was failing to fully document the reasons for the decision and this can be a fatal flaw in the process - as here - really inexcusable and raises a red flag - was this done intentionally by those involved in the process? If so then that was a major failure - add to that lack of safety checks by those in charge to ensure this did not occur - i believe this got started under Jeff Sessions - just sayin….
SCOTUS had a basis to PUNT and they did - they love to punt tough ones. Hope POTUS and BARR get to the bottom of this SNAFU…..
