Even if it was a non-allowed deduction if the company took in "good faith" there is nothing Mueller can do even if he can prove it never should have been allowed. The IRS allowed it (and we know they will look into a billion dollar tax deduction). Mueller can't just say oops you shouldn't have taken that. No way to prove fraud 23 years after the fact unless there is quite the paper trail and witnesses? Statute of limitations to disallow has long since passed.
