When this bill/code is drafted, you MUST include a private action similar to that of the TCPA. Whatever entity is assigned/permitted to enforce violations, there is no possible way that they will be able to deal with each and every one of them. If a private action is implemented, one that allows consumers to act as “Private Attorney Generals”, then consumers will be permitted to sue said social media (type) entities under the new code for either monetary damages and/or injunctive relief. This will allow for the "death by 1000 cuts strategy" if the fed (or assigned enforcement entity) doesn’t get around to dealing with the problem, and/or dealing with it in a timely matter. Furthermore, you will need to include a cost/fees shifting provision as well. That is one item that was missing from the TCPA, and as a result, there are no teeth to prevent violators from dragging out litigation in hopes of a favorable settlement.
