9th Circuit rules in favor of Trump admin in 'sanctuary city' case

 

The 9th Circuit Court of Appeals on Friday ruled in favor of the Trump administration's efforts to prioritize federal dollars for local policing to towns and cities that complied with certain immigration policies.

 

The ruling, a split 2-1 decision, said the Department of Justice (DOJ) was within its rights to withhold Community Oriented Policing Services (COPS) grants from sanctuary cities and states over their refusal to work with federal immigration enforcement authorities and instead prioritize agencies that focused on unauthorized immigration and agreed to give Immigration and Customs Enforcement (ICE) access to jail records and immigrants in custody.

The city of Los Angeles first sued the administration after it was denied a $3 million grant on the grounds that it did not receive the money because it did not focus on immigration for its community policing grant application. The decision reversed a district courtā€™s ruling.

 

ā€œThe panel rejected Los Angelesā€™s argument that DOJā€™s practice of giving additional consideration to applicants that choose to further the two specified federal goals violated the Constitutionā€™s Spending Clause,ā€ wrote Judge Sandra Ikuta, joined by Judge Jay Bybee.

 

ā€œThe panel held that DOJ did not exceed its statutory authority in awarding bonus points to applicants that selected the illegal immigration focus area or that agreed to the Certification,ā€ she wrote.

 

Judge Kim Wardlaw wrote in dissent that the Justice Departmentā€™s efforts to prioritize immigration in determining the awarding of COPS grants was ā€œOrwellianā€ and said the majorityā€™s ruling goes ā€œastray.ā€

 

ā€œThe majority goes astray by finding no meaning in Congressā€™s use of the term ā€˜community-oriented policingā€™ and then deferring under Chevron to DOJā€™s Orwellian effort to define ā€˜community-oriented policingā€™ to include 'partnering with federal law enforcement to address illegal immigration,' ā€ she wrote.

 

ā€œCongress did not authorize COPS grants for anything other than placing additional state and local cops on the beat and promote community partnerships,ā€ she wrote.

 

Congress created the fund in 1994 to provide federal assistance to state and local law enforcement to get more cops on beats and improve police-community interaction. It allowed the Justice Department to administer the funds.

 

President Trump has repeatedly railed against sanctuary cities as he touts his hard-line immigration stances.

 

He floated the idea earlier this year of retaliating by releasing undocumented immigrants and refugees last year to the cities. He also issued an executive order last year blocking sanctuary cities from receiving certain federal funding. San Francisco sued over the order, and ultimately won its case.

Hezbollah leader says U.S. seeking to talk

 

The leader of Hezbollah said on Friday that Washington was seeking to open channels of communication despite ramping up sanctions against the Iran-backed movementā€™s officials.

 

U.S. President Donald ā€œTrumpā€™s administration is seeking to open channels of communication to Hezbollah in Lebanon through mediators. ā€¦ These are the American pragmatists,ā€ Sayyed Hassan Nasrallah said in an interview with Hezbollahā€™s al-Manar TV without elaborating.

There was no immediate comment from the U.S. State Department on the assertion.

 

New sanctions this week marked the first time the United States has targeted lawmakers of the heavily-armed Shiā€™ite Hezbollah, which is part of Lebanonā€™s coalition government.

 

The U.S. Treasury added three Hezbollah figures to its sanctions list, including two Lebanese MPs and a security official.

 

The move widens a U.S. campaign that since 2017 has designated 50 people and entities linked to Hebzollah, which Washington classifies as a ā€œterroristā€ organization.

 

Nasrallah called the new sanctions ā€œan honorā€ that came as ā€œpart of the ongoing battleā€ against Hezbollah and its allies.

 

ā€œWhatā€™s new is the affront to the Lebanese state,ā€ Nasrallah said.

 

ā€œAt the end of the day, Hezbollah is an important part of the country. The Lebanese government will tell the Americans, as it has before, that these are a part we can not ignore.ā€

 

A U.S. State Department official said on Tuesday that the message was that the rest of the Lebanese government ā€œneeds to sever its dealingsā€ with these officials.

 

Lebanese Prime Minister Saad al-Hariri said on Wednesday that the sanctions moved in a ā€œnew direction,ā€ but would not affect government work.
