Mueller declined to say that his investigation was "an official proceeding" – that is an element of the offense of obstruction of justice.

There would be nothing wrong with answering that question (any investigation by the feds should qualify). Perhaps this whole thing was a smokescreen from the start and Mueller is in on it?
