I would suspect the Comey Memos would have been treated like official 702s, especially by the House who wants to Impeach. Since Comey has come online and said:

 

“I didn’t consider it part of an FBI file,” Comey told Fox News' Bret Baier last year. “It was my personal aide-memoire I always thought of it as mine.”

 

They will not be treated as official 702-like files since Comey said so which is why the DOJ declined to prosecute.

 

Therefore, in a future court case (possibly an Impeachment trial in the Senate, they are now memoires, not official 702-like files. Comey had to do this to prevent prosecution.

 

If Comey tries to make them "official" again and enhance their significance, he gets closer to facing prosecution the closer they come to official 702-like products.

 

Perfect Catch-22.
