Under the arcane rules of the DOJ, they likely had to respond to the referral within some period of time so that potential indictees are not under open-ended consideration. That would be constitutional. If you recall, a few months ago the DOJ declined to indict McCabe for the matters underlying his referral by the IG.
In neither case will this be the end of their jeopardy.
