Martial law is not required for military tribunals. The rules for it permit military tribunals whenever the civilian courts are deemed incapable of getting shit right.
Trump has mad a lot of nominations to the civil courts and is unfucking a lot of stuff. But at first the civil courts were NEVER reliable. Now? Sometimes. But only "sometimes".
