A boss move to establish authority is to just pick someone out and fire them. Often absent that, nobody believes you have the authority you claim.

Following that line of thinking for powerful people, I think there’s a good chance Tony Podesta was tried and executed as a first step by the tribunals to establish their authority. A prison sentence wouldn’t establish the necessary authority and personal risk to very powerful criminals otherwise.
