Impeachment is a two step process to complete in full. What Nan is doing is unchartered territory. Given the fact that she is denying step two, has the House really impeached? Normally, when all is said and done, you’d say the House impeached and the Senate did/did not convict. Since the Articles haven’t even been transmitted to the Senate, what does that mean? If the House were to pass a bill, but never send it to the Senate, it’s essentially worthless legislation. If a cop writes a ticket, but never turns it in, did you actually get a ticket? I don’t know, been trying to read some cases on impeachments today. Haven’t seen the situation we’re in addressed directly. Seems like not transmitting to the Senate leaves an opening for POTUS to take it to the SCOTUS. There will be arguments with that route as well I’d guess as far as an impeachment being justiciable.

Does an “indictment” necessarily result in actual charges? While an impeachment is similar to an indictment for the most part, it is a unique process. And one that is a two part process. The second being that it’s handed off to the Senate. I posted some thoughts as well. >>7564826
