fisc judges are semi retired senior judges, moved yo fisc by the chief justice and never approved by the senate for the role they are filling.
its literally not constitutional since the senate never approves them for the court they sit on.
only the president has constitutional authority to appoint federal judges for any role. only the senate has the authority to advise and consent.
