As the sole Constitutional Officer in power, POTUS can appoint Dept. Secretaries during Congressional recesses that normally require advice and consent of the Senate. Prior to Bill Clinton, this rule was seldom used, and when it was, the President did so according to the spirit of the law (i.e. during a Congressional Recess, a Sec'ty becomes incapacitated. When recess ends, POTUS sends a nomination to the Senate).

However, when the Rep's took both houses of Congress, for the first time in 50+ years, the Reps gave Billy and the Dims a taste of their own medicine wrt Sec'ty appointments.

So, true to form, Billy, the Dims, and the MSM REEEEEEE'd at the E|B|IL Reps for rejecting Billy's Hyper Partisan Friends of Bill appointed to the cabinet. Bill decided to use the little used recess apppointments to fill his cabinet for the rest of his reign. The MSM blamed the Reps for forcing Bill, who REALLY DIDN'T WANT TO ABUSE THE RECESS PROCESS, to use the recess process.

It wasn't until President Cheney did the same, that the left got bitchy about it.

Anywho, Recess appointments are only for Cabinet Members. POTUS cannot make recess appointments for the Federal Courts.
