1) Executuve Orders are not enumerated at all in the Constitution, ergo it's a procedural function limited to the executive branch, in order to facilitate the President in making his staff aware of his directives.

2) Congress is the only constitutional body that can make laws, and at that, appropriations and spending bills can only originate from the House.

3) If he tried, the Congress would immediately go to the Supreme Court to have it struck down as unconstitutional, with the side benefit of making POTUS look like a complete idiot for ignoring separation of powers.
