1 โ€˜โ€˜(c) ELECTION AFTER PROCEEDINGS INITIALLY

2 BROUGHT UNDER OTHER CIVIL RIGHTS OR LABOR

3 LAW.โ€”A library claimant who initially brings a claim,

4 complaint, or charge under a direct provision for a pro5

ceeding before a Federal agency may, prior to requesting

6 a hearing under the agencyโ€™s procedures, elect toโ€”

7 โ€˜โ€˜(1) bring any civil action relating to the claim,

8 complaint, or charge, that is available to the Library

9 claimant,

10 โ€˜โ€˜(2) file a complaint with the Office in accord11

ance with section 405, or

12 โ€˜โ€˜(3) file a civil action in accordance with sec13

tion 408 in the United States district court for the

14 district in which the employee is employed or for the

15 District of Columbia.โ€™โ€™.

16 (c) PROSPECTIVE APPLICABILITY.โ€”This section and

17 the amendments made by this sectionโ€”

18 (1) shall take effect on the date of enactment

19 of this section; and

20 (2) shall apply to any charge, complaint, or

21 claim, that is made on or after the date of enact22

ment of this section, of a violation ofโ€”

23 (A) section 201, 202, 203, 207, or 210 of

24 the Congressional Accountability Act of 1995 (2

25 U.S.C. 1311 et seq.); or
