Latest rules state the Senate has to be out for 10 (business) days to do one.

 

But the Senate is never out for 10 days anymore. The Courts have ruled that pro forma sessions where no business is conducted but someone still goes to bring the chamber to order, do count as the Senate being open.

 

There is a pro forma sessions scheduled for Monday. There won't be a 10 day break according to the current rulings.
